Terms of Service

1. Purpose and scope

This Agreement sets out the terms that apply when you order and receive products from a site operated by Santa Here.

Matters relating to exchanges and refunds are governed by the Exchange & Refund Terms, and matters relating to the handling of personal information are governed by the Privacy Policy. On those matters, those documents take precedence over this Agreement.

2. Our status

Santa Here purchases products directly and sells them in its own name. The counterparty to the sales contract with you is Santa Here — we do not act as an intermediary for another seller, nor do we act as your purchasing agent on your behalf.

Products are purchased within Korea and then shipped to you by international delivery.

3. Definitions

Order — a case in which you have selected a product and quantity and completed payment.

Fulfillment stage — the progress status of your order from the time it is placed until the product arrives, viewable on your order detail page.

Order lookup PIN — the number you use to look up your order, which you set yourself at the time of ordering.

4. Formation of the contract

The sales contract is formed at the time your payment is completed.

However, Santa Here may cancel an order in the following cases, in which case any amount paid is refunded in full:

  • The product can no longer be obtained within Korea
  • There was a clear error in the displayed price
  • The product cannot be shipped to the destination country
  • Delivery is not possible using the recipient information you entered

In these cases, we will notify you of the reason on your order detail page and by email.

5. Price and payment

The price shown on a product page does not include international shipping. Shipping is charged separately based on your shipping country and is shown before you pay. It does not include any customs duties or taxes charged by the destination country.

Matters relating to payment currency and exchange rates are governed by the Exchange & Refund Terms.

6. Customs duties and taxes

Customs duties, VAT, other taxes, and customs clearance fees charged by the destination country are your responsibility.

Whether such charges apply and their amount are determined by the laws of the destination country and the value of the product; Santa Here does not collect or determine these charges.

If you refuse to pay customs duties and the product is returned or disposed of as a result, the international shipping cost already incurred and the return cost will be deducted from the refund amount.

7. Shipping

Products depart from Korea and are delivered by international shipping. The delivery time shown on the site is a typical estimate and is not a guaranteed period.

Delivery may be delayed due to the destination country's customs procedures, local delivery conditions, natural disasters, and similar circumstances.

You can check the shipping progress on your order detail page.

8. Order lookup

Santa Here does not require account registration. After placing an order, you can check your order details and request cancellation or a refund using the order lookup PIN you set at the time of ordering.

You are responsible for keeping your PIN secure; anyone who knows your PIN can look up that order and request its cancellation.

If you forget your PIN, please contact us using the email address you entered when ordering.

9. Order cancellation and refunds

Matters relating to order cancellation and refunds are governed by the Exchange & Refund Terms.

10. Prohibited conduct

You may not do any of the following:

  • Place bulk orders for the purpose of resale
  • Enter recipient information that is inaccurate
  • Access the site or place orders using automated means
  • Attempt to look up another customer's order

Orders found to fall under the above may be cancelled.

11. Intellectual property

Rights to the text, images, and design on the site belong to Santa Here or the relevant rights holder.

Some product images and product descriptions are quoted, with attribution, from materials published by the Korean seller; rights to that material belong to the original rights holder.

Customer reviews are translated quotations of reviews published on the Korean seller's site, as indicated in that section.

12. Limitation of liability

Santa Here, as the seller, is responsible for defects, mis-shipment, and damage to products.

However, we are not liable for damage arising from the following causes:

  • Circumstances beyond our control, such as natural disasters, war, or epidemics
  • Changes in the laws or customs policy of the destination country
  • Delivery failure caused by an error in the information you entered
  • Your failure to keep your order lookup PIN secure

We are not liable for individual physical reactions, such as skin reactions, arising from use of a product, except where the product itself is defective.

13. Governing law and dispute resolution

This Agreement and the sales contract are governed by the laws of the Republic of Korea.

However, where the consumer protection laws of the country in which you reside provide you with more favorable protection, those laws take precedence.

In the event of a dispute, we will first attempt an amicable resolution through our inquiry channel; if unresolved, the courts of the Republic of Korea shall have jurisdiction.

14. Changes to this Agreement

If we change this Agreement, we will announce the change and its effective date on the site in advance.

Orders already formed are governed by the Agreement in effect at the time the order was placed.
