1. Purpose and scope

This Agreement sets out the terms that apply when you order and receive products from a site operated by Santa Here.
Matters relating to exchanges and refunds are governed by the Exchange & Refund Terms, and matters relating to the handling of personal information are governed by the Privacy Policy.

In this Agreement, the following terms are defined as follows.
- Order: a case in which you have selected a product and quantity and completed payment.
- Fulfillment stage: the progress status of your order from the time it is placed until the product arrives, viewable on the order confirmation screen.
- Account: membership you can create with an email and password to log in. You can also place an order without an account.
- Order lookup PIN: for orders placed without an account (guest orders), the number you use to look up your order, which you set yourself at the time of ordering.

Santa Here purchases products directly and sells them in its own name.
The counterparty to the sales contract with you is Santa Here — we do not act as an intermediary for another seller, nor do we act as your purchasing agent on your behalf.

The sales contract is formed at the time your payment is completed.
However, Santa Here may cancel an order in the following cases, in which case any amount paid is refunded in full:
- The product became unavailable at the announced price at the time of purchase, such as due to being out of stock
- There was a clear error in the displayed price
- The product cannot be shipped to the destination country
- Delivery is not possible using the recipient information you entered
In these cases, we will notify you of the reason on the order confirmation screen and by email.

The price shown on a product page does not include shipping.
Domestic (Korea) shipping is charged by each seller and is waived once you reach that seller's free-shipping threshold.
International shipping is determined by your destination country and the product's weight.
Domestic (Korea) shipping and international shipping can each be checked in the cart and at checkout.
Customs duties and taxes charged by the destination country are not included.
Matters relating to payment currency and exchange rates are governed by the Exchange & Refund Terms.

Customs duties, VAT, other taxes, and customs clearance fees charged by the destination country are your responsibility.
Whether such charges apply and their amount are determined by the laws of the destination country and the value of the product; Santa Here does not collect or determine these charges.
If you refuse to pay customs duties and the product is returned or disposed of as a result, the international shipping cost already incurred and the return/disposal cost will be deducted from the refund amount.

Products depart from Korea.
Unless you choose pickup in Korea, products are delivered by international shipping.
If you choose pickup in Korea, products are delivered by domestic shipping.
The delivery time shown on the site is a typical estimate and is not a guaranteed period.
Delivery may be delayed due to the destination country's customs procedures, local delivery conditions, natural disasters, and similar circumstances.
You can check the shipping progress on the order confirmation screen.
- If you ordered with an account, you can check it in "My Space" after logging in.
- If you ordered without an account (guest order), you can check it using your order lookup PIN.

Santa Here lets you order and look up your order without creating an account (guest order).
If you ordered while logged in with an account, you can check your order and request cancellation or a refund in "My Space" while logged in, without a PIN.
If you ordered without an account, you can check your order and request cancellation or a refund using the order lookup PIN you set at the time of ordering.
- You are responsible for keeping your PIN secure; anyone who knows your PIN can look up that order and request its cancellation.
- If you forget your PIN, you can request a re-entry link on the order lookup page, sent to the email address you entered when ordering, which lets you look up your order without the PIN.

Matters relating to order cancellation and refunds are governed by the Exchange & Refund Terms.

You may not do any of the following:
- Bulk orders for the purpose of resale — these are classified as commercial imports at customs, so the duty exemption that applies to personal shipments does not apply, and the resulting customs cost may fall on you.
- Entering recipient information that is inaccurate
- Unauthorized access — accessing the site or placing orders using automated means, or attempting to look up another customer's order
Orders found to fall under the above may be cancelled, and your access to the site may be restricted.

Santa Here, as the seller, is responsible for defects, mis-shipment, and damage to products.
However, we are not liable for damage arising from the following causes:
- Circumstances beyond our control, such as natural disasters, war, or epidemics
- Changes in the laws or customs policy of the destination country
- Delivery failure caused by an error in the information you entered
- Your failure to keep your order lookup PIN secure
We are not liable for reactions caused by an individual's skin type or constitution where the product itself is normal, but we are liable for problems caused by a defect in the product itself.

This Agreement and the sales contract are governed by the laws of the Republic of Korea.
However, where the consumer protection laws of the country in which you reside provide you with more favorable protection, those laws take precedence.
In the event of a dispute, we will first attempt an amicable resolution through our inquiry channel; if unresolved, the courts of the Republic of Korea shall have jurisdiction.

Rights to the text, images, and design on the site belong to Santa Here or the relevant rights holder.
Some product images and product descriptions are quoted, with attribution, from materials published by the Korean seller; rights to that material belong to the original rights holder.
Customer reviews are translated quotations of reviews published on the Korean seller's site.

If we change this Agreement, we will announce the change and its effective date on the site in advance.
Orders already formed are governed by the Agreement in effect at the time the order was placed.
The date from which a change takes effect is shown at the bottom of this document as the Effective Date.
